Motor Vehicle Accidents – Insurance Issues

Handling the Insurance Issues after a Motor Vehicle Accident

Personal Injury Lawyer in Pennsylvania and New Jersey

When you have been injured in a car, truck or motorcycle accident, one of the first places you typically turn to get compensation for medical and other expenses is your insurance company. Unfortunately, it can often be a nightmare. Insurance companies are for-profit companies that place the interests of their shareholders above your need to recover for your losses. Accordingly, they will employ a number of tactics to try to delay, deny or diminish your rightful claim. We can help.

Insurance adjusterAt the Law Offices of Neal S. Axe, we offer more than 40 years of practice experience to injured people in New Jersey and Pennsylvania. We will clearly explain the law and the process, as well as your options and chances of success. We will keep you fully informed and involved at all times, so that you can make good decisions about how you want to proceed.

Your Advocate with Insurance Companies

We will be your liaison in all dealings with any insurance company, helping you get all the benefits to which you are entitled. We will make certain all applicable issues are addressed, including:

  • Coverage for uninsured or underinsured motorists — Auto insurance companies typically offer uninsured/underinsured motorists coverage as a rider to your policy. This provision allows you to recover up to a certain amount in damages from your own insurer, should the at-fault party either have no insurance or have inadequate insurance to cover your losses. In Pennsylvania you have the right to purchase stacked uninsured/underinsured motorist coverage which combines UM/UIM limits of the cars covered by the same policy.
  • Identification of all your options for medical expenses, as well as wage loss benefits
  • Zero threshold vs. limitation on lawsuit threshold — In New Jersey, you can choose between zero threshold and limitation on lawsuit threshold. If you choose zero threshold, you may sue an at-fault driver for all types of damages, including non-economic losses (pain and suffering). If, however, you opt for the limitation on lawsuit threshold (at a lower premium), you may only file a personal injury claim for specific types of losses.
  • Any issues that need to be addressed when you have been injured in a motor vehicle accident during the course of employment and/or in another state
